Contesting the deportation of a foreigner
Ukrainian legislation provides for the forced deportation (expulsion) of foreign citizens outside the country in cases where they have committed one of the following offenses:- Residence without proper documents confirming the legality of stay in the territory of Ukraine.
- Staying on the territory of the country after the expiration of the temporary residence permit in Ukraine.
- Prolonged stay on the territory of Ukraine after the permanent residence permit became invalid for any reason.
- There is no registration of a foreigner by place of residence in Ukraine.
- Employment of a foreigner without an appropriate work permit.
- Violation of conditions and rules of employment of foreigners in Ukraine.
- Non-compliance with the rules of moving and changing the place of residence.
- Violation of the rules of transit crossing the Ukrainian territory.
- Violation of the rules for crossing the State Border of Ukraine.
Unfortunately, despite Ukraine's efforts to harmonize its legislation with the requirements of the European community, there are still aspects of the existing legislation that can be characterized as imperfect.
Some international organizations speak more openly on this topic and define them as a violation of fundamental human rights.
In particular, the detention of persons suspected of administrative offenses related to illegal stay on the territory of Ukraine or violation of the rules of movement, employment and registration is carried out without a corresponding court decision.
This means that law enforcement agencies can detain a person and hold them until the end of the court process without a court order.
According to the Constitution of Ukraine, no person can be detained for more than 72 hours without the announcement of suspicion of committing a criminal offense, while foreigners who come under the authority of the migration service and the police can be detained for a significantly longer period of time.
Moreover, they do not have the right to a quick and first-order trial of their case - court practice shows that they can wait for a court hearing for quite a long time.
This certainly does not meet modern international and European standards and directly violates human rights.
The United Nations insists that the legality of a person's legal detention be examined by a court as soon as possible - only such an approach can be acceptable for a country that aspires to become a full member of the world and European community.
Since foreigners are allowed to appeal a court decision on deportation, this possibility exists in the legislation of Ukraine.
