Peculiarities related to the procedure for registering a marriage with foreigners and stateless persons
The state registration body of civil status acts checks the legality of the stay of foreigners or stateless persons on the territory of Ukraine by sending a request to the territorial body of the State Migration Service of Ukraine on the day of receiving the application for state registration of marriage in the following cases:
- Absence of a foreigner or a stateless person with a permanent or temporary residence permit.
- Absence on the last free page of a foreigner’s passport document or a document certifying a person without citizenship, or in the deposit slip, a note about receiving a certificate sealed with a seal.
- If the permanent or temporary residence permit of a foreigner or stateless person was issued by the authorities of the State Migration Service of Ukraine in the Autonomous Republic of Crimea from February 20, 2014 or in the temporarily occupied territories of Donetsk and Luhansk regions from March 1, 2014.
- Presentation of a permanent or temporary residence permit of a foreigner or stateless person, which is subject to exchange in accordance with the Procedure for issuing, issuing, exchanging, canceling, forwarding, withdrawing, returning to the state, invalidating and destroying a temporary residence permit, approved by resolution of the Cabinet of Ministers of Ukraine dated April 25, 2018 No. 322, or the Procedure for issuing, issuing, exchanging, canceling, forwarding, withdrawing, returning to the state, invalidating and destroying a permanent residence permit, approved by Resolution No. 321 of the Cabinet of Ministers of Ukraine dated April 25, 2018.

When submitting an application for marriage registration, a woman and a man must present a passport or other document certifying their identity, or a document confirming a stateless person.
Foreigners and stateless persons who wish to register a marriage in Ukraine must provide the following documents:
- Permanent or temporary residence permit, or other document certifying the legality of their stay on the territory of Ukraine.
Documents that confirm the termination of a previous marriage or the recognition of a marriage as invalid, (for example, a certificate of dissolution of marriage, a court decision on the recognition of marriage as invalid, a death certificate of one of the spouses, or a conclusion of the state registration department of civil status acts on the annulment of the act record of marriage, which other relevant documents are invalid, in accordance with the requirements of the Rules).

If the marriage was concluded in Ukraine, then you have the opportunity to apply for a divorce to one of two bodies: to the Registry of Civil Status Acts (RACS) or to the court.
If you do not have children in common with the second spouse, you can submit documents for divorce to the RACS.
However, if your spouse has minor children or if the other spouse does not agree to the divorce, then in this case it is necessary to apply exclusively to the court.
- If you are a citizen of Ukraine and a foreigner and currently live abroad.
- If both spouses are Ukrainians and live outside of Ukraine.
- If you, as a spouse, are foreigners, but live in Ukraine.
To obtain a divorce through the RATS authority, you need to submit only two documents: a marriage certificate and a passport or a residence permit in Ukraine.
