The process of affixing an apostille is a way of confirming the origin of documents and is a simplified version of their legalization.
In order for documents to be recognized outside of Ukraine, it is necessary to obtain an apostille in Kyiv from a specialized authorized ministry.
An apostille is a compact stamp measuring 10x10 cm, containing important data such as the country and place of issuance of the document, the place of application of the apostille, the number and date of issuance of the apostille, as well as the signature of the official who affixed the stamp.
It is important to note that both the apostille and the consular legalization confirm only the authenticity of the signature of the person who signed the document, as well as the stamp or seal with which it is sealed.
Apostille does not determine the content of the document and does not indicate that the state approves or does not approve the documented information.
This stamp (apostille) is used on various documents, including certificates, diplomas, marriage, birth, death certificates, statutory documents, court decisions, powers of attorney, as well as other official and notarial documents.
Bodies that, in accordance with the legislation of Ukraine, have the right to affix an apostille include:
- Ministry of Education and Science of Ukraine.
- Ministry of Foreign Affairs of Ukraine.
- Ministry of Justice of Ukraine.
Workers first check whether the documents need apostillation, and then check the signatures, stamps or seals by comparing them to the samples on file. They also check the correspondence of signatures on documents with their database. The time required for this procedure depends on the type of document and can vary from 1 to 40 working days. Documents issued by justice authorities (ZAGZ, courts, notaries) can be apostilled in 1-3 working days. In the case of documents related to education (diplomas and certificates), the apostillation process can take from 3 to 40 working days.

Also, an apostille is not put on various identity cards, weapons permits, documents containing correspondence, and legal conclusions.
Documents issued to citizens by diplomatic or consular missions, as well as those related to trade exchange or customs procedures, are exempt from the need for authentication through an apostille. Therefore, such documents are not apostilled.
Sometimes the Ministry can refuse to affix an apostille, this can happen in the following cases:
- Has completely unreadable text due to severe damage.
- Shall be applied in a country that is not related to the Convention or has expressed dissatisfaction with the accession of Ukraine.
- Was received by fax or written in pencil.
- Contains unconditional corrections or additions.
Also, the reason for the refusal may be the impossibility of obtaining samples of stamps/seals or signatures, as well as the lack of authority to put an apostille on this type of document.
Some countries that are parties to the Hague Agreement require a double apostille.
After affixing the apostille on the documents, they must be translated.
Then this translation is notarized, and an additional apostille is also attached to it. This procedure is known as a double apostille.
